Dutch researchers Piet Hein van Kempen and Masha Fedorova of Radboud University published their findings today, confirming what Cannabis News Network concluded earlier this year with a mini-series on (medicinal) cannabis as a human right.
This new study follows the same outcome as the Mexican’s High Court’s decision to grand four activists to grow, transport and smoke cannabis because of their; “right to the free development of personality”.
Whereas other studies focused on arguments related to individual and public health, the safety of citizens and the fight against crime (the so-called positive human rights obligations), to date this is the first study done into cannabis and postive human rights obligations.
De gemeente Groningen treedt niet op tegen de Social Club, waar mensen terecht kunnen voor medicinale wietolie.
Medicinale wiet is in Nederland legaal te krijgen, maar wordt alleen onder strenge voorwaarden verstrekt en is prijzig. Bij de Social Club kunnen mensen lid worden en daarna wietolie kopen. Ze betalen ervoor wat ze kunnen missen. Onder andere kankerpatiënten zeggen er baat bij te hebben; het zou onder meer pijnklachten verlichten.
Strafbaar
Het verstrekken van deze wietolie is strafbaar. Toch komt de gemeente niet in actie. Burgemeester en wethouders schrijven: 'De Social Club heeft aangegeven dat het pand aan de Oostersingel wordt gebruikt voor informatieverstrekking en als ontmoetingspunt. Voor het verstrekken van informatie dan wel inrichten van een ontmoetingspunt voor burgers is in principe geen toestemming vereist.'
De initiatiefnemers hopen op een gesprek met de burgemeester. Ze willen uiteindelijk bereiken dat wat ze doen legaal wordt. Maar het gemeentebestuur vindt dit een landelijke discussie.
Impasse doorbreken
Wel blijft Groningen zich in zijn algemeenheid inzetten voor een ander drugsbeleid. 'Zoals ook in het concept drugsbeleid is aangegeven, zal de gemeente zich blijven inspannen om de impasse rondom de illegale aanvoer van hennep aan coffeeshops te doorbreken en de regulering van de achterdeur van coffeeshops mogelijk te maken.'
A social club for medical cannabis patients in the northern region of the Netherlands is about to open its third illegal location in less than a year, a testament to the Dutch demand for quality cannabis.
The club, Medical Social Club Suver Nuver, has more than 1,200 members and supplies cannabis oil to roughly 2,500 people. All this is technically against the law, but founder Rinus Beintema believes he’s come up with a way to align the club’s activities with existing Dutch cannabis policy. “We steer our own course,” he said. “We’re stubborn farmers here in the north, and we're gonna poke everyone’s ass with our pitchforks."
Although the Netherlands officially legalized medical cannabis in 2003, a large number of patients do not buy the cannabis available in pharmacies, which is produced by a company called Bedrocan. Patients have complained that the five strains offered by Bedrocan are too limited, that the cannabis is treated with gamma radiation, and that only a few insurance companies will cover the cost. Many Dutch patients simply don’t want to smoke and are looking for cannabis in a different form.
Cannabis oil is available at only one Dutch pharmacy, which produces it in-house from Bedrocan buds. Bedrocan has stated that it's working on cannabis oil, but it’s not yet available. As a result, the Netherlands, like a lot of European countries, is home to an underground system for producing and distributing medicinal cannabis oil. And it's growing every day.
It's important to remember that the cultivation of cannabis is still illegal in the Netherlands. To make matters worse, hash oil, another term for cannabis oil, has been listed as a Class A drug since the ‘70s. Apart from the one pharmacy in The Hague that makes its own oils, any production of cannabis oil also is illegal.
The situation hasn't stopped Rinus Beintsema, 49, from starting what he calls a “medical social club” to connect patients, growers, and extractors. Beintsema started working in an Amsterdam coffeeshop around 1980, but he said he only discovered the medicinal properties of cannabis oil about three years ago. To his surprise, the father of one of his friends, who was suffering from severe arthritis, asked him to make cannabis oil. Beintsema had been doing it for years, but only for recreational purposes.
The oil had almost instant effect. Within a week, his friend's father cut his medication in half. “It really opened my eyes,” Beintsema recalls. “I thought, Maybe those Americans are not con men, like I thought. About medical cannabis and dispensaries I used to actually think, They say they've hurt their finger so they can smoke a joint, you know? Like a disguised coffeeshop.”
Within weeks, ten more arthritis patients came to his door. So Beintsema started a Facebook group. “Everyone came running towards me. Before I knew it, I was providing 200 people with cannabis oil,” he recalled, “and this was all still from my attic at home.”
With a few friends he started Medical Social Club Friesland. In addition to making great cheese and dairy products, Friesland, a northern Dutch province, has a reputation for independence and stubbornness. In October 2015, the group opened an establishment in the provincial capital of Friesland, Leeuwarden, leading to a further increase in membership. “After three months, we upped the ante and invited local media to explain what we are doing,” Beintsema said. “From that moment on, the snowball really started rolling downhill."
The club now has a second branch, in the city of Groningen, and a third opening in Zwolle in July. “Every week, about eight kilograms of coconut oil extraction goes out the door,” said Beintsema. His aim is clear: a test trial, leading to full legalization of medical cannabis.
“My strategy in this case is that [of] a bull in a china shop. You stir things up as much as you can and see where the ship will run aground,” he said. “And it's so far, so good, as they say. We're moving at top speed, and you have to keep that momentum going so they don't get a grip on you.
“Unfortunately we haven't seen or heard anything from the Justice Department,” he continued.
“We keep going one step further; I told one newspaper literally that we would like a confrontation, because it's part of the plan.”
Beintsema has met with the mayor of Leeuwarden, Ferd Crone, once. The mayor liked the concept, Beintsema said, but is worried about the concentrates the club offers.
To stay within the limits of the Dutch cannabis policy, Beintsema has come up with a plan. He will start producing so-called Neder-Marok, a combination of a concentrate, Moroccan hash powder, and oil made of cannabis from Moroccan landrace strains. The finished product will be a piece of hash that can be mailed as long as it weighs no more than 5 grams, the maximum amount tolerated for personal use. After delivery, the hash can easily be turned into oil with the use of some alcohol and a coffee filter. “This is Neder-Marok, a hybrid that's the fruit of cooperation between Moroccan and Dutch growers,” he said. “We strongly believe that land races in the countries of origin have the highest medicinal value."
An intervention by the Dutch authorities seems inevitable, but Beintsema and the members of Medical Social Club Suver Nuver are convinced the experiment will eventually lead to a breakthrough. The club will have a booth at Cannabis Liberation Day, the biggest cannabis event in the Netherlands, on June 12 in Amsterdam's Flevopark.
“We've put together a nice team of volunteers and will share our booth with the 710 Crew from Denmark,” Beintsema said. “We're taking a bunch of e-nails and a big pile of wax. We'll be making some sweet smoke clouds over the park.”

ZWOLLE - Zwollenaren kunnen vanaf 1 juli gemakkelijker aan mediwiet komen, er komt een steunpunt dat de wietolie voor medische doeleinden ook in deze regio gaat verspreiden.
De Stichting Suver Nuver uit Leeuwarden verstrekt per 1 juli gratis mediwiet aan leden van de nieuwe Social Club Zwolle. Die krijgt een steunpunt in een kantoorpand ergens in Zwolle.
Social Club Friesland en Groningen heten de steunpunten in Leeuwarden en Groningen waar de stichting al sinds oktober 2015 cannabisextracten voor medische doeleinden aan eigen leden verstrekt. "We hebben inmiddels 1.500 leden", aldus voorzitter Rinus Beintma. "Rondom Zwolle nu al 75 leden."
Draagkracht
Die krijgen 'naar behoefte' wietolie verstrekt. Betaling geschiedt 'naar draagkracht', zegt hij. Voor tien euro per maand kunnen mensen donateur worden. "We pleiten voor een legale situatie voor de mediwiet. Er zijn zoveel mensen die er baat bij hebben, maar nu of illegaal bezig zijn of hele dure mediwiet via hun huisarts moeten afnemen. In de Verenigde Staten is de mediwiet in 5 staten legaal en ook in Canada mag de wietolie gewoon verkocht worden."
Beintma stelt dat er een wezenlijk verschil is met de Cannabis Social Club die in Amsterdam actief was. "Die kweekten hun eigen wiet, illegaal dus. Dat doen wij niet. Daartoe zouden we pas over willen gaan als het gelegaliseerd is."
De olie zou een heilzame werking hebben voor mensen die bijvoorbeeld reuma hebben of andere ziekten die veel pijn oproepen. "Voor sommige mensen is een druppeltje ter grootte van een rijstkorrel al voldoende, een ander heeft aan een eetlepel nog niet genoeg."
Dokter
Mediwiet is legaal alleen verkrijgbaar op doktersrecept. "Maar die heeft vaak een lage concentratie, het is heel duur en wordt niet vergoed door ziektekostenverzekeraars", zegt Beintma. Er zitten geen artsen achter de Social Clubs, bevestigt Beintma. "We leveren de mediwiet in hoeveelheden die we hebben gebaseerd op ervaring en op de feedback die we van clubs uit de Verenigde Staten en Canada krijgen. In principe leveren we naar behoefte, maar onze ervaring is dat 10 milliliter voldoende is voor 7 tot 10 dagen. Als mensen 10 zakjes van 10 milliliter per dag gaan bestellen, vermoeden ook wij dat het voor de verkoop is en leveren we dus niet. We schrappen die mensen dan ook uit ons ledenbestand."
Als de Zwolse vestiging net zo'n explosieve groei in leden oplevert als de ervaring in Leeuwarden en Groningen leerde, is de volgende stad al in zicht. "Dan openen we ook een steunpunt in Utrecht."
Goed nieuws voor SSN, SCF, SCG, SCZ. Is er een sneeuwbaleffect aan het ontstaan in NederlandZWOLLE - Zwolse coffeeshops zijn blij verrast door de komst van een steunpunt voor gratis medicinale wiet. Ze zien de nieuwe service als de 'missing link' op het gebied van mediwiet in Zwolle.
Als er per 1 juli een steunpunt in Zwolle opent waar inwoners van de stad aan gratis wietolie voor medicinaal gebruik kunnen komen, dan zien lokale coffeeshops dit als een goede ontwikkeling. Het steunpunt Social Club Zwolle, opgericht door de stichting Suver Nuver uit Leeuwarden, is volgens Zwolse coffeeshophouders een goede aanvulling op het aanbod van mediwietverstrekkers in de stad.
Prijskaartje
Momenteel is iedereen die legaal wiet wil gebruiken voor medicinale doeleinden, aangewezen op een recept van de huisarts of een bestelling bij de coffeeshop om de hoek. Aan die eerste optie hangt vaak een fiks prijskaartje. De tweede optie betekent onverwerkte wiet of hasj in de coffeeshop kopen en zelf omzetten in bijvoorbeeld wietthee of -olie.
'Verschil maken'
"Maar als het servicepunt straks open is, kan ik me heel goed voorstellen dat mensen die wietolie gebruiken om beter te kunnen slapen of tegen pijn of ziektes, er gebruik van gaan maken", zegt medewerker Bart van coffeeshop Sky High in Zwolle. Hoeveel klanten hij heeft die wiet gebruikt voor medicinale doeleinden is, kan hij niet precies zeggen. "Maar we krijgen regelmatig klanten over de vloer die mediwiet gebruiken."
Ook Ozkan Sevgul, eigenaar van coffeeshop De Tulp in Zwolle, kijkt uit naar de komst van het servicepunt. "Voor een deel van onze klanten zal het punt het verschil maken", zegt hij. "Dit zijn wel mensen die de wiet nodig hebben om pijn te verzachten."
'Behoefte'
Stichting Stuver Nuver zegt inmiddels 1.500 leden te hebben, waarvan zo'n 75 in de omgeving van Zwolle. Leden kunnen 'naar behoefte' wietolie krijgen bij het steunpunt. Betaling van de olie gaat 'naar draagkracht' of op basis van een abonnement.

Een maand nadat er in Groningen een nieuwe vestiging van de (medicinale) Social Club van start ging, kondigt initiatiefnemer Stichting Suver Nuver de volgende uitbreiding aan: Zwolle. Daar gaan op 1 juli de deuren open en kunnen leden gratis wietolie krijgen!
Social Clubs razend populair
De opmars en populariteit van deze Social Clubs in het noorden van Nederland is enorm, wat niet in de laatste plaats veroorzaakt zal worden door het feit dat leden er gratis – of met een bijdrage naar draagkracht – cannabisolie kunnen krijgen en er ook workshops worden gegeven hoe je zelf olie kan maken (zie daarvoor de laatste column van The Stoned Society).
Het origineel ging vorig najaar in Friesland van start en begin vorige maand opende Social Club Groningen de deuren (zie ons bericht van 2 mei jongstleden). Vanaf 1 juli hoeven inwoners van Zwolle en directe omgeving de provincie ook niet meer uit voor hun wietmedicijn, want dan gaat er in de Hanzestad een steunpunt van Stichting Suver Nuver van start!

, om te bedanken voor het goede werk wat SSN-SCF/SCG/SCZ doet!Het is een historisch moment in het Nederlandse softdrugsbeleid: op het jaarlijkse VNG-congres stemden de Nederlandse gemeenten massaal vóór regulering van softdrugs. De Vereniging van Nederlandse Gemeenten (VNG) wil starten met experimenten waarin de teelt van cannabis wordt gereguleerd onder controle van de gemeente. Op dit moment is de teelt van cannabis nog strafbaar.
D66 Tweede Kamerlid Vera Bergkamp werkt aan een initiatief-wetsvoorstel voor de regulering van wietteelt en is erg blij met deze uitkomst: "89% van het VNG-congres die vóór stemmen, dat is een enorm belangrijk signaal voor de landelijke politiek dat dit geregeld moet worden." Ze hoopt dat dit meer kamerleden zal overtuigen om voor haar initiatiefwet te stemmen.
lllegale hennepteelt is zeer lucratief en steeds meer het werkterrein van criminele organisaties. Gemeenten kampen met overlast van de illegale hennepteelt zoals woningbranden, schietpartijen, liquidaties en witwasserij. Door zelf gecontroleerd wietteelt toe te staan, hopen de gemeenten de negatieve gevolgen van wietteelt te beteugelen.
Het kabinet heeft eerder al aangegeven dat ze niet van plan is om iets te wijzigen aan het huidige gedoogbeleid. De VNG gaat nu dan ook inzetten op een politieke lobby, die er voor moet zorgen dat het volgende kabinet wel toestemming geeft voor de experimenten, zegt burgemeester Theo Weterings namens de VNG in de uitzending.
Verder in de uitzending: een reactie van de vertegenwoordiger van de coffeeshops in Nederland. Zij spreken zich uit tegen de komst van staatswiet.
